Disney Springs Restaurant Sued After Father Chokes to Death on Steak “Called Security Instead of 911”. A father of three died after choking on a steak at The Boathouse in Disney Springs, and now his mother is suing. She says the restaurant staff took too long to get help, and that delay cost her son his life. No Difibrillator (AED) at the restaurant, called security first, which delayed calling 911, and an employee encouraged NOT calling 911. It is important to note that Walt Disney World is not named in the suit.

Kevin Lee Duncan, a 42-year-old technician from Ocala, was out to dinner with his family and friends on June 8, 2025. They were in town for his daughter’s dance competition. While eating a steak, Kevin started choking.

His friends and family tried to do the Heimlich maneuver, but they couldn’t clear his airway. The lawsuit says the restaurant staff failed to call 911 immediately. Staff reportedly contacted security first rather than emergency medical services. Discouraged emergency calls: The suit claims at least one employee actively advised against calling 911 during the crisis. Lacked equipment: The restaurant allegedly did not have an automated external defibrillator (AED) on-site.

The family’s attorneys, John Morgan and Edward Combs, stated that “more than two minutes elapsed” before proper help was summoned, leading to severe hypoxia and cardiopulmonary arrest. Duncan was placed on a ventilator but passed away the following day.

The Boathouse is owned by Gibsons Restaurant Group. A spokesperson for the group said they are very sorry for the loss, but they can’t say much more because of the active lawsuit. Disney itself isn’t being sued in this case.
